Bork slips, falls, sues Yale for $1 million plus

Judge Robert Bork, one of the fathers of the modern judicial conservative movement whose nomination to the Supreme Court was rejected by the Senate, is seeking $1,000,000 in compensatory damages, plus punitive damages, after he slipped and fell at the Yale Club of New York City. Judge Bork was scheduled to give a speech at the club, but he fell when mounting the dais, and injured his head and left leg. He alleges that the Yale Club is liable for the $1m plus punitive damages because they "wantonly, willfully, and recklessly" failed to provide staging which he could climb safely.

Judge Bork has been a leading advocate of restricting plaintiffs' ability to recover through tort law. In a 2002 article published in the Harvard Journal of Law & Public Policy--the official journal of the Federalist Society--Bork argued that frivolous claims and excessive punitive damage awards have caused the Constitution to evolve into a document which would allow Congress to enact tort reforms that would have been unconstitutional at the framing:

State tort law today is different in kind from the state tort law known to the generation of the Framers. The present tort system poses dangers to interstate commerce not unlike those faced under the Articles of Confederation. Even if Congress would not, in 1789, have had the power to displace state tort law, the nature of the problem has changed so dramatically as to bring the problem within the scope of the power granted to Congress. Accordingly, proposals, such as placing limits or caps on punitive damages, or eliminating joint or strict liability, which may once have been clearly understood as beyond Congress's power, may now be constitutionally appropriate.

Ted Frank, another leading proponent of tort reform, questions the merits of Judge Bork's claims:

I sympathize with Judge Bork's serious injuries, but it's beyond me what his lawyers are thinking in asking for punitive damages. And if any danger is open and obvious such that there is an assumption of the risk, surely the absence of stairs to reach a lectern on a dais is—especially if the dais is of the "unreasonable" height that the complaint alleges it to be.

At the supermarket where we usually shopped back several years ago, I was forever walking onto an unmarked wet area and my feet would go flying out from under me, up in the air, and over my head, just like in a cartoon. I'd hit those spots, and I would fall, and fall hard. It never did feel good that's for certain, and it didn't help the aches and pains that come along before a rain, however, I never ever once thought of suing. Dumb I suppose as it was negligence on their part. It wasn't my doings as the wet spots weren't visible as their floors were always so shiney.

I've always said that people mispell his name all the time. Supposed to be a capital "D" not "B."

Fucking A, guy can't watch where he's stepping and therefore someone owes him a million bucks. I'd offer him an out of court settlement in the form of a million "fuck off"s.

You know what would really be fun would be to use his own words against him in legal argument. I can see him gnashing his teeth already.

This is one of the clowns behind notions that have been seriously floated in Congress to "cap" damages at a quarter mil. That is exactly how much Bronwyn's rehab cost, and, yes, kids, you do have to pay them back if you get a settlement. She paid Medicaid a quarter mil out of her settlement money. That's the way it works. So, if that cap had been in place, she'd have won her settlement and been rendered destitute at the same time.

But Dork apparently thinks his body is worth four times more than hers, which is permanently damaged on top.

I have news for him. Bronwyn's worth a thousand Borks.

I'd tell him to fuck himself, let's go to court, then, you clumsy fuck. So brilliant you can't climb a few stairs.

Here at work, a guy i work with, some kind of techno geek, uses to go smoke outside. Once when he got back in the office, talking to a coworker when he was walking, he caught his leg in a shoebrush cleaner, fell and broke his leg. The whole scene was caught by one of the many cameras. The video has been sent since then to everyone in the office.

That's EXACTLY why we need more conservatives on the Supreme Court. If Bork hadn't been Borked, he would be on SCOTUS, helping to stop frivolous lawsuits like this.
