Piracy or Convenience?

A boatload of Greg Osby (and others) tracks are available online for downloading. Of course there are dozens of websites like this. This seems to be why the record industry is failing. How can artists and companies make a living when their property is posted unauthorized like this? I play sax and I bought all my cds fair and square. What gives?
