Jazz Composer's Collective Festival
the highlight of my musical year in New York is coming up, the Jazz Composer's Collective festival at the Jazz Standard. a few of the things I'm looking forward to are
- great drummers (Matt Wilson, Ben Perowsky, Jeff Ballard, Michael Sarin)
- the debut of a new project, "Lucky Charms: The Music of Lucky Thompson"
for the rest of you, you should be looking forward to snagging copies of the new CDs by Ron Horton and Frank Kimbrough, both of which I've heard and which are wonderful; I think Ben Allison's new CD will be available too.

and I wish I could catch all of them, but alas I won't. I should be able to make it to two nights at least, though, probably Friday and Saturday or Sunday.
do you suppose they'll get into copyright trouble for calling one of the projects "Lucky Charms"?

I don't know if that was a rhetorical, tongue-in-cheek question, but I believe trademark protections have some kind of limitation to a similar range of products.

Pete, it was semi-rhetorical, kinda tongue-in-cheek. Your answer is interesting, though. So a band could call itself "Diet Coke" without getting into trouble?

I'm not sure, and I'm sure Coke's lawyers could make it too expensive for them to keep the name with legal challenges if they so chose. Once they tried to play around with the Diet Coke logo, they would probably be in trouble. But we need a trademark & copyright lawyer to explain the ins & outs. Don't I remember that JMJ's practice might be related to intellectual property?
The trouble will start when Frank Kimbrough decides to call his next album "Fair & Balanced."

yeah, it doesn't work for bands, I know the X-Men had to change their name to the X-Ecutioners after they'd been around for a few years.

true, but I think it is the rehearsals and getting familiar with all the music that is the real killer for Ben in a week like this (Frank Kimbrough, too - he's in almost as many sets as Ben). Remember that musicians practice all the time, and once upon a time (sigh) many jazz musicians played multiple sets many nights in a row as a matter of course.

up for Jazz Corner member Frank Kimbrough, who is playing tonight with Ron Horton. I'm going to be there for two sets on Friday or Saturday, and hopefully Sunday as well. I may try to slip in one set of Frank's trio on Thursday, too...

This is my first post for the "new" JC. I've been on vacation in Florida and am now back but sick with a very bad cold! At any rate, with trademark the standard is if there would be some confusion of the products with the two names, IOW, would the band "Lucky Charms" be confused with the cereal with those gooey marshmallow things in it? Probably not. So I guess the band name "Lucky Charms" is safe. Remember how Dan D'Imperio got in trouble when he had his band the "Metropolitan Bopera Group" or somesuch? That's probably the wrong name and I'm sure I'll hear from Dan. But the Metropolitan Opera took the band to court to make them stop using the name!
I want so much to go to Ron's gig tonight but I'm so sick I don't know if I'll be able to. Then this weekend I have all kinds of other tickets I had already purchased. The Philharmonic, with Pincus Zuckerman on Sat. and then "King Lear" on Sunday!! This JC Collective week just came on me all of a sudden. I'm scarcely prepared for it,. I will try to make Friday's gigs though.
